Hereunder, is the planning permission for the new build on Boithrin na Lachan in 1992, Waterford County Council in fairness then gave Boithrin na Lachan its full title as both as a road and a public right of way. In items they 4 and 5 they refer to it as a road and in item 2 they refer to it as public right of way and claim that were protecting it. However, the conditions as proscribed in the schedule were never adhered to and were never followed up by Waterford County Council as if they were we would not have the mess we have on Boithrin na Lachan today. The big takeaway from this planning decision is that Waterford County Council recognise it as a road and a public right of way.
